FrameTap Terms of Service

These Terms of Service (“Terms”) form a binding agreement between FOP Raksha Yaroslav, trading as FrameTap (“FrameTap,” “we,” “us,” or “our”), and the person or entity that installs or uses FrameTap (“Merchant,” “you,” or “your”).
By installing the FrameTap app from Shopify, creating or accessing a FrameTap workspace, clicking to accept these Terms, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not install or use the Service.
1. Definitions
- “Service” means FrameTap’s Shopify application, web dashboards, APIs, preview tools, documentation, theme libraries, and related services that enable Merchants to design, customize, preview, and publish a mobile shopping app experience for their Shopify store.
- “App” means the mobile shopping experience (including preview and published versions) configured through the Service for a Merchant’s store.
- “Builder Content” means themes, pages, blocks, components, navigation, icons, design tokens, settings, configurations, and other materials Merchants create or upload in the Service.
- “End Customer” means a shopper or mobile user of an App associated with a Merchant’s store.
- “Shopify” means Shopify Inc. and its affiliates, including the Shopify platform, Admin, App Store, APIs, Checkout, Files, and App Billing services.
- “Subscription” means a paid or trial plan entitling the Merchant to use specified Service features for a billing period.
- “Personal Data” has the meaning under applicable data protection laws.
2. Eligibility and Account Registration
2.1 Shopify Merchants
The Service is offered to businesses that operate a Shopify store and install FrameTap via Shopify’s authentication flow. Accounts are associated primarily with a shop domain and Shopify session credentials rather than a separate FrameTap password login (unless a future feature expressly provides otherwise).
2.2 Authority
If you use the Service on behalf of a company, store brand, or other entity, you represent that you have authority to bind that entity. “You” includes that entity.
2.3 Accuracy and access control
You must:
- Provide accurate store information and keep Shopify staff access correctly permissioned
- Safeguard admin credentials and revoke access for former staff
- Ensure only authorized users modify themes, connect integrations, or change billing
2.4 Age and capacity
You must have legal capacity to enter a commercial contract. The Service is not directed at consumers shopping for personal use of FrameTap itself; it is a B2B tool for Merchants.
3. Subscription Plans, Billing, Trials, and Cancellations
3.1 Plans and pricing
FrameTap offers subscription plans with different feature entitlements. Current plan names and list prices (USD, billed every 30 days via Shopify) include:

Feature lists (for example, push notification allowances, product recommendations, advanced customization, priority support) are defined in the Service UI and marketing materials and may change. If there is a conflict between marketing copy and the live billed plan, the Shopify subscription charge and in-app entitlements actually provisioned control for that billing period.
3.2 Billing through Shopify
All Subscription fees for the Shopify app are billed through Shopify’s App Billing. Payment methods, invoices, taxes applied by Shopify, currency conversion, and payment disputes are handled primarily under Shopify’s systems and policies. FrameTap stores subscription metadata needed to grant entitlements.
3.3 Trials
Where a trial is offered (for example, a 14-day Growth trial for first-time eligible merchants), trial eligibility, duration, and conversion to paid status are determined by the Service’s billing configuration and Shopify’s confirmation webhooks. After the trial ends, continued use of paid features requires an active paid Subscription.
3.4 Upgrades, downgrades, and proration
Plan changes initiated in the Service are processed according to Shopify billing APIs and may be prorated as configured (for cancellations, the Service may request proration of remaining balances through Shopify where available). Exact proration timing appears in Shopify Admin and/or Shopify billing confirmations.
3.5 Cancellation
You may cancel a Subscription through the Service’s plan settings and/or Shopify’s billing controls. Cancellation stops future renewals according to Shopify billing rules. You remain responsible for charges incurred before cancellation becomes effective. Cancellation of billing does not automatically delete all stored Builder Content; see Section 12 and the Privacy Policy for deletion.
3.6 Unpaid or failed charges
If billing fails or a Subscription lapses, we may suspend paid features (including publishing of Apps), while still allowing you to manage or export data where reasonably feasible. We may reinstate access when payment is restored.
3.7 Taxes
Fees may be exclusive of taxes. Shopify may collect taxes as required. You are responsible for taxes applicable to your business other than taxes based on FrameTap’s net income.
3.8 Price changes
We may change prices or entitlements with notice consistent with Shopify’s app billing rules and applicable law. Continued paid use after a price change notice period constitutes acceptance of the new price for subsequent periods.
3.9 Refunds
Except where required by law or expressly stated in writing by FrameTap, Subscription fees charged through Shopify are non-refundable, including unused time in a billing period after cancellation. Billing disputes should first be raised with support@frametap.app and via Shopify’s channels where applicable.
4. License to Use the Service and Builder
4.1 Limited license
Subject to these Terms and an active entitlement (where required), FrameTap grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely to design, preview, and operate Apps for your own Shopify stores in accordance with the features of your plan.
4.2 Builder usage
You may:
- Create and edit Builder Content within plan limits
- Publish one or more mobile themes as allowed by the product (for example, a live published mobile theme per shop as implemented)
- Use FrameTap-provided templates and components solely within the Service
You may not reverse engineer, scrape, resell, white-label, or provide the Service as a managed service to third parties except as expressly permitted in writing.
4.3 Beta features
We may offer alpha/beta features. They are provided as-is, may be withdrawn at any time, and may be subject to additional terms.
5. Merchant Responsibilities
You are solely responsible for:
- Your store and catalog — Product accuracy, pricing, inventory, compliance of product offerings, and fulfillment
- End Customer relationships — Customer service, refunds, shipping, and disputes arising from orders placed through Shopify checkout from your App
- Legal compliance — Applicable advertising, privacy, consumer protection, product safety, export, and accessibility laws in markets you serve
- Privacy notices and consents — Informing End Customers about analytics, push notifications, cookies/trackers, and any sales/sharing under laws such as GDPR, UK GDPR, and CCPA; obtaining required consents
- Content legality — Ensuring Builder Content, media, and notifications do not infringe rights or violate law
- Shopify compliance — Complying with Shopify’s Terms of Service, Acceptable Use, App, and API policies
- Staff and agents — All activity under your shop’s installation
- Mobile distribution (if you distribute a native binary) — If you ship branded iOS/Android applications, you are responsible for Apple App Store / Google Play developer accounts, review guidelines, privacy labels, age ratings, and listing content, unless a separate written agreement with FrameTap expressly covers those tasks
FrameTap does not replace your legal, accounting, or compliance advisors.
6. Shopify Integration and Permissions
6.1 Authorization
By installing FrameTap, you authorize FrameTap to access your Shopify store data within the API scopes you approve, including (as of the current product) scopes related to reading/writing files, reading (and scoped writing) products, and related theme scopes declared for the app. Scope lists may be updated with Shopify’s consent/update flows when features change.
6.2 Purpose of access
We use Shopify data to:
- Sync product and collection catalogs for mobile search and browsing
- Enable builder product/collection linking and previews
- Host merchant media via Shopify Files where applicable
- Maintain shop currency and related display settings
- Support optional review displays via product metafields and third-party review tools
- Enforce Subscriptions via Shopify Billing
6.3 Revocation
If you revoke permissions or uninstall the app, the Service will lose access and may cease to function (including published App experiences that depend on FrameTap APIs). Certain data may be deleted or de-indexed as described in the Privacy Policy.
6.4 Platform dependency
The Service depends on Shopify’s availability, APIs, policies, and your store’s compliance status. Shopify may suspend your store or our access for reasons outside FrameTap’s control. We are not liable for Shopify outages or policy enforcement.
7. App Publishing and Deployment
7.1 What “publish” means in FrameTap
Within the Service, publishing generally means making a configured mobile theme live so that FrameTap-powered mobile experiences for your shop load that theme (subject to plan entitlements, authentication, and technical availability). Publish status is managed in FrameTap’s systems for your shop.
7.2 What FrameTap does not guarantee
Unless a separate written agreement expressly says otherwise, FrameTap:
- Does not guarantee automated submission or approval of your binary to Apple App Store or Google Play
- Does not guarantee uninterrupted availability of Apps
- Does not guarantee that search indices, catalogs, or webhooks will be perfectly real-time at all times
- Does not guarantee that End Customers’ devices will support all features
7.3 Preview vs production
Preview experiences may use different base URLs, tokens, or incomplete configurations and must not be treated as production guarantees. You should test thoroughly before marketing the App to End Customers.
7.4 Feature gating
Certain features (for example, push notifications, product recommendation blocks, advanced customization) may require Growth, Pro, or later-named paid plans. Attempting to use gated features without entitlement may result in disabled UI, blocked publish, or limited runtime behavior.
8. Merchant Content and License to FrameTap
8.1 Ownership
As between you and FrameTap, you retain ownership of your Builder Content, store branding, product data, and other materials you provide (subject to third-party rights and Shopify’s rights in platform data).
8.2 License you grant us
You grant FrameTap a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and create technical derivatives (for example, cached previews, search indices, thumbnails) of Builder Content and authorized store data solely to provide, secure, improve, and support the Service and as otherwise described in the Privacy Policy.
8.3 Representations
You represent that you have all rights necessary to grant this license and that your content does not violate law or third-party rights.
8.4 Feedback
If you provide feedback or suggestions, you grant FrameTap a perpetual, irrevocable, royalty-free license to use them without restriction or attribution.
9. Intellectual Property
9.1 FrameTap IP
FrameTap and its licensors own all right, title, and interest in the Service, including software, design systems, documentation, FrameTap trademarks, proprietary templates labeled as FrameTap’s, and the visual builder platform itself. No rights are granted except as expressly stated.
9.2 Restrictions
You will not:
- Copy, modify, or create derivative works of the Service except as the builder interface allows
- Remove proprietary notices
- Access the Service to build a competing product using non-public materials or reverse engineering
- Use FrameTap trademarks without prior written permission except for factual references
9.3 Theme templates
FrameTap may provide starter themes and library assets. Unless marked otherwise, those materials may be used only within the Service to create Apps for your store. Redistribution of FrameTap’s template packages outside the Service is prohibited.
9.4 Open source
The Service may include open-source components under their own licenses. Those licenses govern the relevant components.
10. Third-Party Services
The Service interoperates with third parties, including:
- Shopify (authentication, store data, files, billing, checkout)
- Search infrastructure (for example, Algolia) for catalog search
- Mobile push infrastructure (for example, Expo Push)
- CDN / media for FrameTap static assets (for example, Cloudinary)
- Optional review platforms you connect (for example, Judge.me, Yotpo, Okendo, Loox)
- Font or design utilities (for example, Google Fonts APIs)
Third-party services are governed by their own terms and privacy policies. FrameTap does not control and is not responsible for third-party services, including outages, data practices, or pricing, except to the extent required by law. Your use of optional integrations is at your election and risk. Credentials you provide for third-party tools should be managed carefully; FrameTap may store them encrypted for convenience of the integration.
11. Acceptable Use
You will not, and will not allow others to:
- Use the Service for unlawful, fraudulent, or deceptive purposes
- Infringe intellectual property, privacy, or publicity rights
- Upload malware, harmful code, or exploit payloads into themes or media
- Interfere with or disrupt the Service, other Merchants, or End Customers
- Attempt unauthorized access to systems, data, or other stores
- Scrape or bulk harvest the Service or other Merchants’ data beyond normal product use
- Send spam or illegal electronic marketing (including abusive push notifications)
- Circumvent plan limits, billing, or technical protections
- Use the Service in a way that violates Shopify, Apple, or Google platform rules
- Misrepresent affiliation with FrameTap or imply endorsement without permission
- Process special categories of Personal Data or children’s data through the Service in unlawful ways
We may investigate violations and cooperate with law enforcement or Shopify as appropriate.
12. Suspension and Termination
12.1 By you
You may stop using the Service and uninstall the app at any time. Cancellation of Subscriptions is addressed in Section 3.
12.2 By FrameTap
We may suspend or terminate access (in whole or part) immediately if:
- You breach these Terms or the Privacy Policy
- Your Shopify store is suspended or the app is uninstalled
- Billing fails or required fees are unpaid
- Continued provision creates security, legal, or platform-policy risk
- We discontinue the Service with reasonable notice where practicable
12.3 Effect of termination
Upon termination or uninstall:
- Your license to use the Service ends
- Published Apps reliant on FrameTap backends may stop functioning
- We may delete or de-identify data according to the Privacy Policy and legal retention needs
- Sections that by nature should survive (including IP, disclaimers, liability limits, indemnities, governing law) continue to apply
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” FRAMETAP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE SERVICE OR APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- CATALOG SEARCH, SYNC, ANALYTICS, OR PUSH DELIVERY WILL BE COMPLETE OR REAL-TIME
- RESULTS WILL MEET YOUR COMMERCIAL EXPECTATIONS OR INCREASE SALES
- THIRD-PARTY PLATFORMS (INCLUDING SHOPIFY, APPLE, GOOGLE, ALGOLIA, EXPO) WILL REMAIN COMPATIBLE OR AVAILABLE
YOU ASSUME RESPONSIBILITY FOR DECISIONS MADE BASED ON ANALYTICS OR BUILDER OUTPUTS.
Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, exclusions apply to the fullest extent permitted.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
14.1 Exclusion of damages
FRAMETAP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, GOODWILL, OR DATA; BUSINESS INTERRUPTION; OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
14.2 Liability cap
FRAMETAP’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO FRAMETAP FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU HAVE NOT PAID ANY FEES.
14.3 Basis of the bargain
These limitations are a fundamental basis of the commercial arrangement and apply regardless of theory of liability (contract, tort, strict liability, or otherwise), except where liability cannot be limited under applicable law (for example, intentional misconduct or liability that cannot be waived for death/personal injury caused by negligence where such rule applies).
15. Indemnification
You will defend, indemnify, and hold harmless FrameTap and its officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your Builder Content, App content, or marketing
- Your products, sales, fulfillment, taxes, or End Customer disputes
- Your violation of law, Shopify policies, or third-party rights
- Push notifications or analytics practices you configure
- Claims by End Customers relating to your App or store
- Your breach of these Terms
We will provide reasonable notice of covered claims and may participate in the defense with our own counsel at our expense. You will not settle any claim admitting fault of FrameTap without our prior written consent.
16. Changes to the Service and to These Terms
16.1 Service changes
We may modify, suspend, or discontinue features, plan limits, integrations, or the Service as a whole. We will use commercially reasonable efforts to give advance notice of material adverse changes where practical, but may act immediately for security, legal, or platform-mandated reasons.
16.2 Terms changes
We may update these Terms by posting a revised version with a new “Last Updated” date at https://frametap.app/terms and/or notifying you in the app. Material changes will take effect no sooner than the date stated in the notice, or immediately if required for legal compliance. Continued use after the effective date constitutes acceptance, except where mandatory law requires a different process.
17. Governing Law and Dispute Resolution
17.1 Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Ukraine, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.
17.2 Venue
Subject to mandatory law, the competent courts of Ukraine shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in Ukraine.
17.3 Informal resolution
Before filing a claim, you agree to attempt to resolve the dispute informally by contacting support@frametap.app and providing a reasonable description of the issue. We will attempt to resolve disputes in good faith within thirty (30) days of receiving complete information.
17.4 Injunctive relief
Either party may seek interim injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.
18. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy, and any order or plan confirmation via Shopify constitute the entire agreement and supersede prior understandings regarding the Service.
- Severability. If any provision is unenforceable, the remainder remains in effect.
- Assignment. You may not assign these Terms without our consent; we may assign to an affiliate or successor.
- No waiver. Failure to enforce a provision is not a waiver.
- Force majeure. We are not liable for delays caused by events beyond reasonable control, including failures of Shopify or major cloud providers.
- Notices. We may notify you via the Shopify app, email associated with your Shopify staff profile (if available), or https://frametap.app/. Legal notices to us: support@frametap.app / Ukraine, Zaporizhzhia, Ladozka 34/11.
- Language. These Terms are in English. Any translation is for convenience; English controls unless mandatory law requires otherwise.
- Relationship. The parties are independent contractors. No partnership or employment is created.
- Third-party beneficiaries. Except as expressly stated (including indemnified persons), there are no third-party beneficiaries. Shopify is not a party to these Terms.

Annex A — Data Processing Terms (Processor Role)
This Annex applies when FrameTap processes Personal Data as a processor on behalf of the Merchant (the controller) in connection with the Service, as described in the Privacy Policy. Together with the Privacy Policy, this Annex constitutes FrameTap’s standard data processing terms for Merchants. A separately signed enterprise DPA is not required for ordinary use; Merchants needing a countersigned schedule may contact support@frametap.app.
A.1 Subject matter and duration
FrameTap processes Personal Data to provide the Service (including catalog sync, builder hosting, App runtime APIs, analytics instrumentation, and push delivery) for the duration of the Merchant’s use of the Service and any post-termination retention period required for deletion assistance or legal obligations.
A.2 Nature and purpose of processing
Hosting, storage, transmission, indexing, analysis (for Merchant dashboards), push delivery, security logging, backup, and deletion—solely to provide and secure the Service as instructed by Merchant configuration and these Terms.
A.3 Types of Personal Data
May include, depending on Merchant use:
- Merchant staff identifiers provided via Shopify sessions
- End Customer pseudonymous identifiers and device/push tokens
- End Customer activity data (page views, product interactions, search strings, cart/checkout funnel events, purchase completion metadata such as order id and amounts as reported by the App)
- Content of push notifications composed by Merchants if they include personal identifiers
Categories of data subjects: Merchant staff users; End Customers of Merchants.
A.4 Merchant instructions
Merchant instructs FrameTap to process Personal Data only:
- To provide the Service as configured by the Merchant
- As documented in these Terms and the Privacy Policy
- As required by law (in which case FrameTap will inform Merchant unless legally prohibited)
Merchant is responsible for the lawfulness of instructions and for notices/consents to End Customers.
A.5 Confidentiality and security
FrameTap ensures personnel with access to Personal Data are bound by confidentiality and implements technical and organizational measures appropriate to the risk (see Privacy Policy).
A.6 Subprocessors
Merchant authorizes FrameTap to engage subprocessors listed (and as updated) in the Privacy Policy (Section 10), including Shopify, Algolia, Expo Push, Cloudinary (FrameTap assets), Render, and optional Merchant-configured review providers. FrameTap will impose data protection terms on subprocessors no less protective than this Annex in material respects.
Notice of material changes: FrameTap will update the Privacy Policy subprocessor list at https://frametap.app/privacy when engaging a material new subprocessor. Merchant may object by terminating the Service within thirty (30) days of the updated Policy’s Last Updated date if the parties cannot resolve the objection.
A.7 International transfers
Where FrameTap transfers Personal Data internationally, FrameTap will implement appropriate safeguards as described in the Privacy Policy and as required by law.
A.8 Assistance with data subject rights
Taking into account the nature of processing, FrameTap will provide commercially reasonable assistance to Merchant to respond to data subject requests under GDPR/UK GDPR/CCPA that relate to Personal Data FrameTap processes as processor. Complex retrieval projects may be subject to a reasonable professional services fee where permitted.
A.9 Breach notification
FrameTap will notify Merchant without undue delay after becoming aware of a Personal Data breach affecting Merchant Processor Data, with information reasonably available to assist Merchant’s legal obligations.
A.10 Deletion or return
Upon Merchant’s written request after termination, or upon uninstall as implemented, FrameTap will delete or return Processor Data within a commercially reasonable period, except copies retained in backups until overwritten or required by law. Merchant acknowledges that residual deleted data may remain in encrypted backups for a limited period.
A.11 Audits
Upon reasonable written request no more than once annually (unless a regulator or documented incident requires more), FrameTap will provide available security documentation or other information reasonably necessary to demonstrate compliance with this Annex. On-site audits, if required by mandatory law or a documented regulator demand, will be scheduled during business hours on reasonable notice and at Merchant’s expense unless a material non-compliance is found.
A.12 Controller data outside this Annex
Merchant account billing metadata and FrameTap’s own product analytics processed as controller are outside Merchant-as-controller instructions and are governed by the Privacy Policy’s controller sections.
